These Terms of Service govern your use of neighborsite.net and any services provided by NeighborSite. By using our website, submitting a form, or purchasing a service, you agree to these terms.

If you are entering into this agreement on behalf of a business, you confirm you have authority to do so.
What we provide
NeighborSite builds and maintains websites and customer-communication tools for local service businesses. Depending on what you sign up for, services may include:
- Design, build, and hosting of a website
- Ongoing edits, updates, and maintenance
- A dedicated business phone number used for follow-up messaging
- Automatic text replies to callers you were unable to answer
- Notifications to you about calls, messages, and voicemails
- Automated review requests to your customers
The specific scope for your account is what we agree to in writing when you sign up. Work outside that scope is quoted separately.
Fees & billing
Our plans are billed monthly in advance on the same day each month, with no setup fee and $0 due at signup:
- Website — $149/month. Custom site, hosting, domain, SSL, and content edits while your account is active.
- Website + Automation — $249/month. Everything above, plus missed-call text-back and automatic review requests.
- Automation only — $149/month. Missed-call text-back and review requests for businesses that already have a website.
Pricing for your account is whatever we agreed to in writing at signup, which may differ from the rates above.
On automation plans, phone and messaging usage is passed through to you at cost with no markup — typically $10–25 per month depending on call volume — and billed in addition to your monthly fee. One-time carrier registration fees are also passed through at cost.
Billing begins when your service goes live, not when you sign up. If a payment fails, we'll contact you. If it remains unpaid for 10 days, we may suspend service until the balance is cleared. Fees already paid are not refundable, and we do not prorate partial months.
Our guarantee
If you don't like the free preview, you owe nothing and we delete it. If you sign up and aren't happy with the finished site, you don't pay and we take it down.

Consent
By providing your phone number and agreeing to be contacted, you consent to receive text messages from NeighborSite. Consent is not a condition of purchase. You may withdraw consent at any time.
What we send
Replies to your inquiry, quotes and estimate follow-ups, appointment confirmations and reminders, service updates, review requests, and account or billing notices.
Frequency and cost
Message frequency varies based on your interaction with us. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
Opting out
Reply STOP to any message to opt out. You'll get one confirmation message and nothing further. Reply HELP for assistance, or email [email protected].
Sharing of mobile information
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
If you are our client
When we send messages on behalf of your business, you are the sender of record. You are responsible for obtaining valid consent from every person you ask us to message, for keeping records of that consent, and for complying with the Telephone Consumer Protection Act and all applicable messaging laws. You will not ask us to message purchased lists, scraped numbers, or anyone who has opted out. We may suspend messaging immediately if we believe consent practices are non-compliant.
Your responsibilities
- Give us accurate business information, including your legal name and tax ID as filed
- Provide content, photos, and approvals in a reasonable timeframe
- Confirm you have the right to use any logo, photo, or text you send us
- Keep your account and login credentials secure
- Respond to customer messages that reach you through our system
- Tell us promptly if you change carriers, phone numbers, or business details
Delays caused by missing content or approvals extend our timelines accordingly.
Ownership
- Your content
- Your business name, logo, photos, copy, and customer data remain yours. You grant us permission to use them to build and operate your service.
- Your domain and listings
- Your domain name and Google Business Profile remain yours. We act as an administrator, not an owner.
- Your phone number
- Any dedicated number we provision for you is yours to keep. On cancellation, you may request that we release or port it to another provider at no charge, provided your account is paid current.
- Our work
- Our underlying templates, code, workflows, and systems remain ours. On cancellation you receive an export of your site content and customer data, not the underlying platform.
- Portfolio use
- We may show your finished website in our portfolio and marketing unless you ask us in writing not to.
Third-party services
Our services depend on third-party providers for hosting, messaging, telephony, and payments. We are not responsible for outages, price changes, policy changes, or service interruptions caused by those providers, or by mobile carriers.
Carrier registration for business text messaging is reviewed and approved by outside parties. We cannot guarantee approval or a specific approval timeline.
Cancellation
Service is month-to-month with no minimum term and no long-term contract. Either of us may cancel with 30 days' written notice by email. Your service continues through the end of the notice period, and no further charges apply after that.
We may suspend or terminate service immediately for non-payment, for abusive or illegal use, or for messaging practices that put our carrier standing at risk.
On cancellation you receive an export of your website content and customer data, and we release your phone number and domain on request.
No guarantee of results
We do not guarantee any specific number of leads, calls, customers, revenue, search ranking, or return on investment. Results depend on factors outside our control, including your market, pricing, availability, reputation, and how quickly you respond to the leads our system delivers.
Acceptable use
You agree not to use our services to send unlawful, deceptive, harassing, or unsolicited messages; to advertise products or services prohibited by mobile carriers; to impersonate another business; or to violate any applicable law. Prohibited message categories include, without limitation, cannabis, illegal substances, firearms, high-risk lending, and gambling.
Limitation of liability
Our services are provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, NeighborSite is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, or lost data.
Our total liability for any claim arising out of these terms is limited to the amount you paid us in the three months preceding the claim.
Indemnification
You agree to defend, indemnify, and hold harmless NeighborSite from any claim, demand, penalty, or expense — including reasonable attorneys' fees — arising out of your content, your use of our services, your messaging consent practices, or your violation of these terms or any law.
Governing law
These terms are governed by the laws of the State of Kansas, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Barton County, Kansas, and both parties consent to that jurisdiction.
If any provision of these terms is found unenforceable, the rest remain in effect.
Changes to these terms
We may update these terms from time to time. We'll revise the "Last updated" date above, and we'll notify active clients by email of any material change at least 30 days before it takes effect. Continued use after that means you accept the updated terms.
